We at Certainly (including any subsidiaries) are committed to protecting your privacy. This Privacy Policy applies to both our Websites and our Service, including our associated applications owned and controlled by Certainly. This Privacy Policy governs our data collection, processing and usage practices. It also describes your choices regarding use, access and correction of your personal information. If you do not agree with the data practices described in this Privacy Policy, you should not use the Websites or the Subscription Service.

We periodically update this Privacy Policy. We will post any privacy policy changes on this page and, if the changes are significant, we will provide a more prominent notice by sending you an email notification, or if you subscribe to the Service, through the notifications in your Certainly account. While we will notify you of any material changes to this Privacy Policy, we encourage you to review this Privacy Policy periodically. We will also keep prior versions of this Privacy Policy in an archive for your review. Our Services

We only hold the data necessary to offer services provided on our websites and/or our Services.

Collection of personal data

Collection when registering

We collect information about you when you register to use the Services and provide contact information to us via instant messaging, email, mail, or through the Services. This information you provide may include your username, first and last name, email address, mailing address and phone number as well as other information, such as geographic area, preferences, transaction information, credit card or other billing information.

Other collection

When you access or use our Services, we automatically collect information about you, including:

  • Log Information: we log information about your use of our Services, including the type of browser you use, access times, pages viewed, your IP address, and the page you visited before navigating to our Services.
  • Device information: we collect information about the device you use to access our Services, including information about the device's software and hardware, Media Access Control ("MAC") address and other unique device identifiers, device token, mobile network information and time zone.
  • Usage information: we collect information relating to your use of our Services, including which applications you use.
  • Consumption information: we collect information about your consumption habits relating to your use of our Services, including which purchases you make.
  • Information collected by cookies and other tracking technologies: we use various technologies to collect information, and this may include sending cookies to your computer or mobile device. User Data

We use your information in the following ways:

  • Operational Data

The information we collect is used to operate, maintain, optimize, improve and provide the Service, to provide service and information to you and to provide customer support. Furthermore, we use information to control unauthorized use or abuse of the Services, or otherwise detect, investigate or prevent activities that may violate our policies or be illegal. Your Customer Data is processed only in accordance with instructions and may include but not be limited to full name, e-mail address and telephone number. We use data to contact you for administrative purposes such as customer service, to address intellectual property infringement, privacy violations or defamation issues related to the Customer Data or Personal Data posted on the Service or with newsletters, updates on promotions and events, relating to products and services offered by us and by third parties we work with.

  • Reporting Data

The information we collect is used to report statistical data for reporting, analyzing and optimization the performance of the Service in general and/or the chatbots. The data is anonymous.

  • Disclosure to collaborating partners

We use a number of partners and subcontractors with whom we have agreements with in order to process personal data. Standard Contractual Clauses (SCC) are used if the processing takes place in the United States. The agreements regulate what personal data is being processed, why the processing is done, how personal data are to be protected, how it can be processed and for how long.

  • Your rights

You are at any time entitled to be informed of the personal data about you that we process, but with certain legislative exceptions. You also have the right to object to the collection and further processing of your personal data including profiling/automated decision-making. Furthermore, you have the right to have your personal data rectified, erased or blocked. Moreover, you have the right to receive information about you that you have provided to us, and the right to have this information transmitted to another data controller (data portability).   • Withdrawal of consent

You may, at any time, withdraw any consent you have given and we will no longer process your personal data, unless we can continue the processing based on another purpose. If you wish to withdraw your consent, please email us at privacy@certainly.io.

  • Amendment of data

If you want us to update, amend or delete the personal data that we process about you, if you wish to get access to the data, or if you have any questions concerning the above guidelines, please email us at privacy@certainly.io.

  • Deletion of personal data

We will delete your personal data when we no longer need to process them in relation to one or more of the purposes set out above. Generally, we will store your personal for as long as there is still an active subscription and when required to deliver the service and support. Otherwise we will store your personal data for up to 8 weeks or longer if legal requirements demand us to do so. However, the data may be processed and stored for a longer period in anonymised form in order for us to improve the service.

Data Storage & Security

Data is only used for the purposes described in our entry on the Data Protection Agreement, located at certainly.io/dpa.

  • Data Protection Agreement

If you are a paying subscriber to the Service, to the extent that Certainly processes any Personal Information (as defined in the DPA) contained in User Content that is subject to the GDPR (as defined in the DPA), on your behalf, in the provision of the Service, the terms of the data processing agreement at certainly.io/dpa ("DPA"), which are hereby incorporated by reference, shall apply and the parties agree to comply with such terms. For the purposes of the Standard Contractual Clauses attached to the DPA, when you are the data exporter, your agreeing to these Terms of Service shall be treated as signing of the DPA, including, without limitation, the Standard Contractual Clauses and their Appendices.

  • Security

We have implemented security measures to ensure that our internal procedures meet our high security policy standards. Accordingly, we strive to protect the quality and integrity of your personal data. This may include encryption of data and use of pseudonymisation or anonymisation whenever applicable. Read more here certainly.io/data-policy. It also includes physical and logical access control, backup, logs, encrypted communications and other measures to mitigate risks. However, the data may be processed and stored for a longer period in anonymised form in order for us to improve the service.

  • Required Period

We only hold personal data for as long as necessary. Once data is no longer needed it is deleted from our files.

  • Email and Chatbot Updates

We regularly send website news and information updates via email or chatbot to those customers who have specifically subscribed to our updates service. All subscription messages sent by us contain clear information on how to unsubscribe from our updates service.

  • Our Promise

We never sell or exchange subscribers lists and/or contact information related to our subscribers.

  • Data Shared With Partners

We may however share commercial and technical data with our partners where a customer has accessed and used our website and/or our service via a online property owned and/or controlled by one of our partners. However, such information will also be subject to our partners' privacy policies.

  • Email or Chatbot Options

If you subscribe to our service via a partner site, that partner may wish to send you details via email and/or chatbot of other products and services, which may be of interest to you. However when you subscribe directly to our updates service you will be asked whether or not you wish to receive such updates.

  • Partner Privacy Policies

Please note that we only share data with partners that operate their own privacy policy.

  • Product Updates

We may send emails and/or chatbot messages to existing customers or prospective customers who have enquired or registered with us, regarding products or services directly provided by us.

  • Email and/or Chatbot Content

All emails and/or chatbot messages sent by us will be clearly marked as originating from us. There will be clear instructions on how unsubscribe from our updates service and any future messages. Such instructions will either include a link to a page to unsubscribe or a valid email address to which you should reply, with "unsubscribe" as the email subject heading or a chatbot message to which you should reply, with "unsubscribe".
